Terms of Service - avatarware

These Terms of Service (“Terms”) govern your use of AvatarWare, a product of Durostech, including the AI Avatar Generator, the Image to Avatar Generator, and all related features (collectively, the “Service”). By using the Service, you agree to these Terms.

1. Using AvatarWare

You must be at least 13 years old to use the Service. You are responsible for the accuracy of information you provide and for maintaining the security of your account credentials.

2. Acceptable Use

You agree not to use AvatarWare to generate content that is illegal, infringing, defamatory, or that impersonates a real person without consent. You may only upload photos you own or have permission to use.

3. Ownership of Generated Avatars

Subject to your compliance with these Terms and your plan’s license terms, you own the avatars you generate through AvatarWare and may use them for personal or commercial purposes as described on our Pricing page.

4. Subscriptions and Billing

Paid plans renew automatically at the interval selected until cancelled. You can cancel anytime from your account settings; access continues until the end of the current billing period. See our Refund Policy for details on eligibility.

5. Service Availability

We aim to keep AvatarWare available and performant but do not guarantee uninterrupted access. We may modify or discontinue features with reasonable notice where practical.

6. Intellectual Property

The AvatarWare name, logo, and underlying software are the property of Durostech. These Terms do not grant you rights to our trademarks or proprietary technology beyond using the Service as intended.

7. Limitation of Liability

The Service is provided “as is.” To the maximum extent permitted by law, Durostech is not liable for indirect, incidental, or consequential damages arising from your use of AvatarWare.

8. Termination

We may suspend or terminate access for violations of these Terms, including misuse of the image upload features or abuse of the Service.

9. Changes to These Terms

We may update these Terms periodically. Continued use of AvatarWare after changes take effect constitutes acceptance of the updated Terms.
